Legislative Update: On December 24, 2009 the Senate passed H.R. 3590, the Patient Protection and Affordable Care Act, by a vote of 60-39. On March 21, 2010, the House passed the same bill by a vote of 219-212. President Obama signed the bill into law (PL 111-148) on March 23, 2010.
On March 21st, the House also passed H.R. 4872, the Reconciliation Act of 2010, by a vote of 220-211. This bill made modifications to PL 111-148. The Senate slightly amended the bill and passed it on March 25, 2010 by a vote of 56-43. Later that evening, the House passed H.R. 4872 as modified by the Senate by a vote of 220-207. The President is expected to sign H.R. 4872 into law the week of March 29th.

Based on recent legislative developments, the National Restaurant Association's officers and members of our Executive Committee unanimously decided to actively oppose the current health care reform legislation before Congress.
Beginning immediately, we are activating our members, generating calls and letters to Congress, and making our voices heard through the media. Chairman Mike Gibbons sent a memo to the board in which he stated, “While, with your support, our consistent and committed efforts over the past year have led to the inclusion of a penalty-free treatment for part-time employees, a 90-day penalty-free waiting period, ERISA provisions for multi-state operators, and progress on the definition of a full-time employee, the current legislation significantly weakens the small business exemption, imposes severe administrative burdens, and includes extremely onerous penalties for full-time employees. As a whole, the bill is unacceptable and must be actively resisted.” Chairman Michael Gibbons' memo can be read in its entirety here.

We are broadcasting our opposition to the health care reform package and encouraging our industry to speak out against it. Further updates will be broadcast on Twitter, Facebook, and the NRA Leaders’ Blog. We will be working until the vote to urge lawmakers to oppose the bill. We are all in agreement that this is the time to take this stand.
